1. What TuWatch Is

TuWatch Africa is a pay-per-view (PPV) streaming platform dedicated to African cinema and storytelling. We provide viewers with on-demand access to films, series, and events produced by African filmmakers. Access to individual titles is unlocked using our in-platform currency, Shilingi (₴).

2. Accounts & Eligibility

• You must be at least 13 years of age to create an account. If you are under 18, you confirm that a parent or guardian has consented to these Terms.
• You agree to provide accurate, current, and complete information when creating your account and to keep it up to date.
• You are responsible for maintaining the security of your login and for all activity that occurs under your account.
• TuWatch Africa reserves the right to suspend or terminate accounts that violate these Terms.

3. Purchases & Shilingi Wallet

• Pay-per-view: each title has a listed price in Shilingi. Once you unlock a title, your access is permanent. There are no expiry dates on viewer unlocks.
• Wallet top-ups: Shilingi credits are purchased via Paystack (M-Pesa or card). Wallet credits do not expire.
• Non-transferable: Shilingi wallet credits are tied to your account and cannot be transferred, gifted, or exchanged for cash.
• Refund policy: we do not issue refunds for completed purchases except in the case of a verified technical failure that prevented you from accessing content you paid for. To request a refund under this exception, contact us within 7 days at hello@tuwatch.africa.

4. Venue Licensing

• A venue license grants a single venue the right to screen a specified title at a specified event. Licenses are single-use and non-transferable.
• Venue licenses grant access to a 48-hour streaming window for the licensed event. The stream must not be recorded, broadcast, or redistributed in any form.
• The licensee is responsible for ensuring that the screening complies with applicable laws and for any required public performance clearances beyond the rights granted here.

5. Content & Intellectual Property

• Filmmaker ownership: filmmakers who submit titles to TuWatch Africa retain full copyright and ownership of their work.
• Distribution license: by submitting a title, filmmakers grant TuWatch Africa a non-exclusive, worldwide license to host, stream, and promote the title on the platform for the duration of their submission agreement.
• Viewer license: when you unlock a title, you receive a personal, non-commercial license to stream it for your own private viewing. No other rights are granted.

6. Prohibited Use

You must not:

• Download, record, capture, redistribute, or publicly exhibit any content from TuWatch Africa without explicit written permission.
• Circumvent, disable, or otherwise interfere with any access controls, DRM, or security features of the platform.
• Share your account credentials or allow others to use your account to access paid content.
• Use the platform for any unlawful purpose or in violation of any applicable law.
• Attempt to reverse-engineer, scrape, or otherwise extract content or data from the platform.

Violation of these prohibitions may result in immediate account termination and potential legal action.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of Kenya. Any disputes arising from or relating to these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Kenya.

8. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date above and notify you via email if the changes are material. Continued use of the platform after changes are published constitutes your acceptance of the revised Terms.
